Diabetes Australia is here to advise you on discriminatory matters in the workplace.
Diabetes falls under the category of disability within the Equal Employment Opportunity Commission. Disability includes past, present or future physical, intellectual or psychiatric disability, learning disorders, or any organism capable of causing disease.
Both Federal and New South Wales laws say that it is against the law to discriminate against people, or treat them unfairly, in various areas of public life. One of these areas is employment.
In general, you have the right to apply for and be fairly considered for jobs, apprenticeships and traineeships on the basis of merit. In general, you have the right to be trained, promoted, get all other work benefits, and have to follow all other work rules fairly in the same way as other employees. You have the right not to be harassed about your disability.
An employer can only dismiss you, medically retire you, or make you redundant because of your disability - if the disability stops you doing your job properly.
